O Coletivo Terra Vermelha esteve presente na Aty Guasu – Grande Assembleia dos Guarani-Kaiowá- em Paranhos, na terra tradicional Arroio Korá, entre os dias 15 a 18 de julho. Os membros do CTV tinham um desafio e tanto, levar a “Cartilha de Direitos”, confeccionada pelos nossos próprios ativistas, em que são abordadas questões relativas aos direitos indígenas inseridos na Constituição Federal de 1988, bem como as várias tentativas de proposições normativas – PEC 215, Portaria 303 da AGU, PL 1216/15- de eliminar esses direitos consagrados na Carta Cidadã. Ainda, o CTV exibiu o filme “Índio Cidadão?”, do diretor Rodrigo Siqueira, que trata dessa mesma temática. Durante a Aty Guasu, várias autoridades estavam presentes, dentre elas, o Procurador do MPF (Ministério Público Federal), Dr. Marco Antônio Delfino de Almeida, que informou a todxxs que em consequência da Representação protocolada no MPF pelo CTV ,contra o diretor do filme “Matem os outros”, Reynaldo Paes de Barros, duas ações judiciais estão tramitando em desfavor do mesmo, uma ação cível de indenização por danos morais e outra ação criminal pelo crime de racismo.

Senhores e senhoras autoridades. Falaremos pouco e de maneira direta neste documento. Usaremos poucas palavras porque muita coisa já foi dita, muito documento ja foi entregue e mesmo assim muita pouca coisa até então foi feita. A presidência e os Ministérios SABEM de tudo que acontece com nosso povo e são cúmplices do agronegócio e até mesmo parceiros daqueles que nos massacram e sempre nos massacraram.
Por isso nós Guarani e Kaiowa de todas as Tekoha do Estado do MS presentes em nossa grande assembleia – ATY GUASU – embalados pelo som do Mbaraka de nossos Nhanderu e Nhandecy, rezadores e rezadoras, decidimos que já é hora de falarmos menos e agirmos mais para defender de uma vez por todas os princípios daquilo que nos mantem como povo, NOSSA YVY, NOSSO TEKO e NOSSO NEE.
Neste Grande Encontro todos concordamos que a luta seguirá e que nossas retomadas seguirão. Do mais novo e pequeno de nós até o mais velho, nosso Rezador, nosso cacique, nossa liderança, nosso professor, nossa mulher, nosso jovem, nosso agente de saúde, todos os presentes estão prontos para continuar a retomada de nossos territórios e nós dizemos aos senhores e senhoras que não recuaremos um só passo. A partir das retomadas e da luta pela terra buscaremos todos os nossos direitos, na saúde, na educação, nas políticas básicas e em tudo que fortaleça nossa cultura, nossa autodeterminação e nosso modo de ser originário.
Com isso não estamos dizendo que vamos provocar a Guerra contra o KARAI, mas dizemos com toda nossas palavras e com todo nosso coração que com toda certeza resistiremos com força aos ataques dos três setores Estado Brasileiro, do Governo do Estado do MS, do agronegócio, do desenvolvimentismo e das forças de segurança. Não queremos a guerra, mas não fugiremos dela quando fugir significa ver nosso povo morrendo na beira das estradas ou mendigando por condições mínimas de vida humana e de espaço dentro de nossos próprios territórios originários e sagrados.
Vocês, senhores e senhoras que se dizem autoridades deveriam se envergonhar pela parte que cabe a cada um de vocês no genocídio que é praticado contra nosso povo. A cada dois dias e meio um Kaiowa morre no Mato Grosso do Sul. Todos sabem quem são os assassinos e este crime é praticado a céu aberto, em horário nobre e até mesmo dentro das estruturas que os senhores e senhoras insistem em chamar de casas da democracia.
Hoje, tudo esta ligado. O Governo do Estado coloca abertamente a estrutura do Estado do MS, setor jurídico e forças de segurança (D.O.F) para garantir a continuidade do roubo de nossos territórios e do extermínio do nosso povo. Isso esta registrado. Os ruralistas fazem reuniões abertas nos fóruns do Estado e em especial na Assembleia Legislativa como se estivessem em seus sindicatos rurais. Com o apoio do Governador e de seus secretários, deputados e ruralistas fazem discursos de morte contra nosso povo, que se transformam na perseguição de nossas lideranças e no ataque direto contra nossos Tekoha. É a pratica concreta do genocídio presente nas palavras e discursos de ódio dos deputados da bancada ruralista que desmontam nossos direitos constitucionais através da PEC 215, PL 227, PL 01216 e tantos outros decretos de morte.
Os ruralistas avançam contra a constituição em Brasília e contra o povo Guarani e Kaiowa nas nossas Tekoha, porque o próprio executivo garante a eles a paralisação da demarcação de nossas terras e a não publicação e continuação dos estudos de identificação, negando desta forma nosso mais sagrado direito. E para demonstrar ainda mais sua lealdade com o agronegócio, ataca de forma direta nossos direitos através da AGU com a portaria 303 e com o Ministro da Justiça, suas minutas e mesas de dialogo. Igual o que faz o estado do MS, o MJ e a Presidência vem se colocando ha muito tempo a disposição do ruralismo, e dos setores dominantes e exploradores.
Quanto ao novo presidente da FUNAI, sabemos que o Ministro da Justiça já determinou que ele não continue os estudos de nossos Tekoha, que acabe com nossas retomadas e até mesmo puna servidores da FUNAI que cumpram com suas obrigações. Dizemos que os Guarani e Kaiowa querem dialogar e serem amigos do senhor presidente, mas iremos cuidar e isso ira depender de qual lado ele escolhera e denunciaremos todo e qualquer desrespeito a nossos direitos, repressão a nossas comunidades e sucateamento das estruturas locais da FUNAI.
Enquanto tudo isso ocorre, o poder Judiciário, através da segunda turma do STF, onde os ministros deveriam ser os guardiões da constituição, revisam, reduzem e anulam nossas terras já demarcadas através do “Marco temporal”, que impõe de forma criminosa e de má fé que nossas terras so podem ser demarcadas se comprovarmos que estávamos sobre elas em 05 de outubro de 1988 mesmo que os ministros tenham consciência de que muitos entre nós não justamente não estávamos sobre nossas terras porque fomos sequestrados pelo Estado e carregados para reservas criadas pelo próprio Estado ao mesmo tempo que fomos expulsos também pelas balas dos fazendeiros em parceria com o pau de arara e os campos de concentração dos militares.
Nosso povo, por causa do marco temporal e das demais estratégias do ruralismo junto com a justiça, enquanto não tem suas terras demarcadas é despejado pelos juízes locais pagando pelos crimes que o Estado e Governo cometem para que os fazendeiros e os donos dos empreendimentos fiquem ainda mais ricos com a exploração de nossas terras.
Por isso nossa primeira decisão coletiva e unificada é que não haverá nenhum despejo de famílias do nosso povo. Nós nos juntaremos e resistiremos até a morte para defender nossas Tekoha. Tey Jusu, Itágua, Pindoroky, Kurusu Amba, Guyviry e Apykai e todas as outras que sofrerem ataques da justiça pertencem a todo o povo Guarani e Kaiowa e serão defendidos por todo nosso povo.
Falando de Apykai, onde o despejo já foi determinado, avisamos que marcharemos de todos os lugares e resistiremos as decisões criminosas do juiz Fabio Kaiut Nunes, o qual acusamos de defender o agronegócio, de propor genocídio e de libertar das decisões da lei os assassinos de nosso povo. Para alem de decretar a morte de Damiana e das famílias de Apykai após intervir nas tentativas humanitárias do Ministério Publico Federal de garantir as mínimas condições de vida e território para Apykai ainda liberou os assassinos da GASPEM (empresa privada de segurança) do pagamento de indenização de bens coletivos para a comunidade de Guyviry onde estes jagunços assassinaram Nisio Gomes, nossa grande e querida liderança. Depois isso, com a estrutura do Estado e da União a disposição, os fazendeiros, junto com DOF e com GASPEM começaram a atacar novamente nossas Tekoha promovendo atos de terror contra nossas comunidades e perseguindo nossas lideranças.
Nossa segunda decisão coletiva é que não recuaremos um só passo de nossas retomadas e dizemos abertamente que enquanto o governo não garantir nosso direito, dar continuidade aos estudos, demarcar e desintrusar nossos territórios, nossas retomadas irão continuar com cada vez mais força. É uma decisão de todo nosso povo e é a única opção que temos de garantir a salvação de nossas terras sagradas. A partir de nossa principal arma, o Mbaraka a terra voltará para nossos velhos e jovens e viveremos plenamente nossa cultura e nossos modos antigos.
Lembramos ao Executivo que seu papel para impedir conflitos e garantir a ordem é cumprir com sua obrigação constitucional de demarcar nossos territórios e não organizar força tarefa para retirar indígenas de suas terras sagradas para despejar na beira das rodovias. Se o Ministro da Justiça tentar avançar contra nossas retomadas isso só fará aumentar o numero de mortes que os ministros e a presidência já carregam nas suas costas.
Para finalizar reafirmamos que cada um de nós, Guarani e Kaiowa que morrer por conta dos ataques dos fazendeiros e da violência do Governo não serão mais enterrados e esquecidos nos fundos de fazenda ou na beira de rodovias. Levaremos seus corpos e os enterraremos na explanada dos ministérios para que vocês vejam todos os dias as cruzes que vemos e que tenham que conversar com a consciência cada vez que forem rasgar a constituição federal e massacrar nosso povo em nome dos interesses políticos e econômicos que fazem vocês trair o Brasil e seus filhos mais antigos.

To all Brazilian authorities. In this document we’ll talk little and in a direct manner. We won’t use many words because a lot has been said, a lot of paperwork has already been prompted and yet up to now very little has been made. The president and the ministries KNOW of everything that happens to our people and, lately, are not only accomplices of agribusiness but also partners of those who massacre us and have always massacred.
Therefore we, Guarani Kaiowa from all parts of our traditional lands, Tekohas, located in Mato Grosso do Sul State, Brazil, present in our great assembly – ATY GUASU – rocked by the sounds of Mbaraka (our native rattle) from our Nhanderu and Nhandecy, prayers and chanters; we have decided that it is about time to talk less and act more to defend once and for all the principles of what keeps us as a single people, OUR YVY, OUR TEKO and OUR NEE.
In this great gathering of ours, we all agreed that our fight will continue and that the partial retaking of our Tekohas will go on. From the newest and smallest to the oldest of us, our shamans, our chiefs, our leaderships, our teachers, our women, our youth, our health care agents; all the Guarani Kaiowa are ready to continue the retaking of our territories and we say to all that we will not retreat a single step. Starting in our retaking and our struggle for the land we will seek for our rights, health, education, the basic policies and everything else needed to strengthen our culture, our self-determination and our original way of being.
With these words we are not saying that we will start the War against KARAI, yet we are saying with all our words and with all our hearts that surely we will forcefully resist the attacks from the three sectors of the Brazilian State, the Mato Grosso do Sul state government, agribusiness, of developmentalism and their armed forces. We do not want war, but we will not flee to escape when that means seeing our people dying on the side of the roads or begging for minimum conditions of human life and space that within our own originating and sacred territories.
You, ladies and gentlemen who call yourselves authorities, should be ashamed of the part that is up to each of you in the genocide that is practiced against our people. Every two and a half days one Kaiowa dies in Mato Grosso do Sul. Everyone knows who the killers are, and this crime is practiced in the open air, at prime time and even within the structures that you lords and ladies insist on calling “democracy houses”.
Nowadays, everything is interconnected. The State Government openly puts Mato Grosso do Sul’s state structure, legal sector and security forces (DOF) to ensure the continuity of the theft of our territories and the extermination of our people. This has been registered. The big farmers have open meetings in the state’s forums and particularly in the Legislative Assembly as if they were meeting in their rural unions. Having the support of the Governor and his secretaries, many of the deputies and big farmers make death speeches against our people, which translates in the pursuit of our leaders and the direct attack against us in our Tekoha. This is the genuine practice of the genocide presented in the words and hate speech of the rural caucus which is dismantling our constitutional rights through PEC 215, PL 227, PL 01 216 and many other decrees of death.
The rural caucus advance against the Brazilian constitution in Brasilia and against the Guarani Kaiowa people in our Tekoha because the executive power itself guarantees them the suspension of the demarcation of our lands, and the failure to publish the anthropological studies along with the continuing identification of our Tekohas, therefore denying our most sacred right. And to further prove their loyalty to the agribusiness, our rights are directly attacked through the AGU with the decree 303 and the Minister of Justice, with their drafts and dialogue tables. Likewise the state of Mato Grosso do Sul, for a long time the Minister of Justice and the Presidency have been putting themselves at the disposal of the rural caucus, and dominant and exploitative sectors of society.
As for the new president of FUNAI (the Brazilian governmental protection agency for Indian interests), we know that the Minister of Justice has determined that he does not continue the studies of our Tekoha, that he ends our retakes and even punish the FUNAI servers that comply with their obligations. We say that the Guarani Kaiowa want to dialog and to be friends of the President, but we will above all look after ourselves and this will depend on which side he choses to take, we will also report any and all disregards of our rights, repression of our communities and the scrapping of local FUNAI structures.
While all of this occurs, the judiciary, through the second group of the Supreme Court, where the ministers should be the guardians of the constitution, revise, reduce and cancel our lands already demarcated by the “Temporal Mark”, which imposes in a criminal manner and in bad faith that our land can only be demarcated so if we prove that we were on them on October 5, 1988; even if the ministers are aware that many among us could not have been on our lands because they were kidnapped by the state and carried out to reserves created by the state itself, and at the same time we were also driven out by the bullets of farmers in partnership with torture strategies and military concentration camps for the Indians.
Our people, due to the temporal mark and the other rural caucus’ strategies along with the Brazilian justice, while we don’t have our land demarcated we are dumped by local judges and we are paying for the crimes that the State and Government commit in order to make the farmers and enterprise owners even richer with the exploitation of our lands.
Therefore our first collective and unified decision is that there will be no eviction of families of our people. We will unite and we will resist until death to defend our Tekoha. Tey Jusu, Itaguá, Pindoroky, Kurusu Amba, Guyviry and Apykai and all other Tekohas which suffer attacks from the Brazilian justice, belong to all the Guarani Kaiowa people, and will be defended by all of our people.
Speaking of Apykai where the dumping has been already determined, we warn that we will march from everywhere to resist the criminal decisions of the judge Fabio Kaiut Nunes, who we accuse of defending the agribusiness, of proposing genocide and freeing from the law decisions the murderers our people. In addition to decree the death of Damiana and Apykai families after intervening in the humanitarian efforts from the Federal Public Ministry aiming to ensure the minimum conditions of life and territory in Apykai also releasing the killers of GASPEM (private security company) from indemnity payment of collective goods for the Guyviry community where these gunmen assassinated Nisio Gomes, our great and beloved leader. After this, with the structure of the state and the willingness of the Union, farmers, along with DOF and GASPEM started attacking again our Tekoha promoting acts of terror against our communities and pursuing our leaders.
Our second collective decision is that we will not retreat one single step in our Tekoha retakes and we want to openly say that while the government does not guarantee our rights, continue the anthropological studies, do the demarcation and expel intruders from our territories, our retakes will continue with increasing strength. It is a decision of all of our people and it is the only option we have to ensure the salvation of our sacred land. From our main weapon, the Mbaraka (rattle), the land will belong once again to our elder and youth to fully live our culture in our traditional ways.
We would like to remind the executive of their role to prevent conflicts and ensure order, that is to comply with its constitutional obligation to demarcate our territories instead of organizing task forces to remove indigenous peoples from their sacred lands in order to dump them on the edge of roads. If the Minister of Justice tries to advance against our retakes this will only increase the number of deaths that ministers and the presidency already carry on their back.
Finally we reaffirm that each of us, Guarani and Kaiowa that dies because of the attacks of farmers and the government’s violence will no longer be buried and forgotten in some farms’ outskirts or on the edge of highways. We will instead take their bodies and bury them in front of the ministries in Brasilia so that the guilty have to see the crosses we see every day and then they will have to talk to their consciousness each time they tear the federal constitution and massacre our people in the name of political and economic interests, that make them betray not only Brazil but also its oldest children
